Charter (English) marks the temporary hiring of an article against paying a use fee.
The conditions of the hiring are regulated in a freight contract. In particular in the navigation and in aviation the term is used, if on renting basis vehicles are being used for a certain time of others than the owners. If it concerns chartering sail and motorboats for vacation or Regatten, one generally calls this yacht charter.
Tourism enterprises often charter airplanes, therefore the term of charter flights comes.
The classification of the freight contract into the contract types of the German law of contract causes difficulties because of the numerous different arrangements. Usually it concerns a contract of employment and not around a work contract. If the entire ship or airplane is left to the charterer without crew for a certain time completely for use (so-called bareboat charter or dry leases), then a lease is present. Even if the hiring of the crew is owed due to a Employment clause, then the regulations of the law of carriage are usually used. If the charterer (e.g. the airline) leaves only one contingent at places for passengers (e.g. to a tour operator), then a work contract with the obligation is obvious for collecting transport.
